A Nigerian lawyer, has explained why a married man can not be convicted for raping his spouse even if she regarded the sexual act as rape.
The lawyer, Stella made it known that marital or spousal rape is not a crime in Nigeria.
She cited two reasons why a man cannot be convicted for raping his wife no matter the circumstances under which the husband had sexual intercourse with her.
Stella emphasized that as long as the wife is legally married to a man, the woman can never claim she was raped by him.

“CAN A HUSBAND RÃPË HIS WIFE? A WIFE who is LEGALLY MARRIED to a MAN CANNOT claim that her HUSBAND RAPED her no matter the CIRCUMSTANCES under which the HUSBAND had SËX with her,” she wrote in a post on Saturday.
"This is because, the OFFENCE of SPOUSAL or MARITAL RÃPÊ is YET to be provided in any LAW in NIGERIA.
"A man CANNOT be CONVICTED for the offence of RÃPING his WIFE.
"SECTION 282(2) of the penal code act
“SECTION 357 of the criminal code act.”
